Terms Of Use

Thank you for taking the time to read this page. The Terms used to be fairly short until there were too many instances of abuse. This includes people expecting to email copies of the images to other people, refusing to place a credit link when using the image(s) online, and making other graphics out of them to give away for free. I had no choice but to make the Terms more specific to protect my rights.

Plain English:

1. You can't pass out copies of the images or loan your CD to anyone. They have to buy their own.

2. You can't sell the images.

3. You can't use them online unless you give a credit link to www.redhatclipart.com. Include the link on each page you display the image. Link instructions. This rule doesn't apply to the images on the Scrapbooking CD, they are for home use only.

4. You can't use them for a business, they're for personal use only. If you need images for your business, please see the Business Use images.

5. You can't post them in forums, message or chat boards. These are places where the images can be downloaded by anyone who reads the post and the copyright information becomes lost.

6. You may not include them in a graphics collection of any kind. This includes lumping them together with other images and calling it your own collection.

7. Don't alter them or use them for illegal purposes. You can add text to any image.

Legal Language:

Terms Of Use are designed to protect the Purchaser (you), as well as the Owner (Red Hat Clip Art.com). It grants you the right to legally use copyrighted material. All images contained on this web site are owned by Red Hat Clip Art.com (a representative name of the exclusive copyright owner, Brenda Ammons) and are protected by United States Copyright laws, international treaty provisions, and other applicable laws. No title to or intellectual property rights to the image(s) or other storage media are transferred to you. Red Hat Clip Art.com retains all rights not expressly granted by these Terms.

The following is a legal agreement between you and Red Hat Clip Art.com. Read this carefully before purchasing and/or using the images on the CD. By making your purchase, breaking the seal of the envelope containing the CD, downloading an image(s) from the CD or website, or otherwise obtaining any image(s) from this web site, you agree to be bound by the Terms.

You shall retain total control and possession of the CD and/or image(s) and shall not allow the CD and/or image(s) to fall in the possession of any third party.

Restrictions:

1. You may not make (or allow anyone else to make) any form of copy, whether printed, photographic, digital and/or other modality of any of the images, except in the use of the image(s) in your personal crafts. The CD may not be copied in its entirety except for backup purposes.

2. You may not loan, rent, transfer or grant any rights to the CD and/or image(s) contained hereon, or any compilation, derivative or collective work containing such images to any other person or organization without the prior written consent of Red Hat Clip Art.com.

3. You may not use them online unless you give a credit link to www.redhatclipart.com for the original artwork. Include the link on each page you display the image.

4. You may not use any image from the CD for your business. This includes auction sites (Ebay, etc.) and web sites that make a profit of any kind. If you need images for your business, please see the "Business Use" images.

7. You may not use or permit the use of the image(s), or any part thereof, as a trademark or service mark, or claim any proprietary rights of any sort in the image(s) or any part thereof.

8. You may not use the image(s) in any way that could be considered defamatory, pornographic, libelous, immoral, obscene or fraudulent, or illegal, either by making physical changes to it with accompanying text or images, or otherwise.

Due to the nature of this product, no refunds can be given after Purchaser breaks the seal of the envelope containing the CD, downloads an image(s) from the CD or website, or otherwise obtains any image(s) from this web site.

Termination and Revocation:

The right to use the CD and/or image(s) will terminate automatically without notice from Owner if Purchaser fails to comply with any provision of the Terms. Upon termination, Purchaser must immediately stop using the material, destroy or, upon the request of Licensor, return the material to Owner, and delete or remove the material from Purchaser's premises, computer systems and storage (electronic or physical).

Owner reserves the right to revoke the use of the material for good cause. Upon notice of any revocation, Purchaser shall immediately cease using such material. You will not be entitled to a refund.

You can terminate your rights to use the material by destroying the CD and/or image(s), along with any copies or archives, any accompanying materials (if applicable), and ceasing all use of the CD and/or image(s) for any purpose.

Warranty and Limitation of Liability:

Red Hat Clip Art.com has the right to make these Terms and to grant the rights hereunder;

The image(s) or other storage media will be free from defects in materials and workmanship under normal use for a period of 30 days from the date of license; and

The image(s) as provided hereunder, and used as permitted herein, will not infringe any copyright, trademark, moral right, right of privacy or any other intellectual property right of any third party.
